These Terms & Conditions (“Terms”) govern your access to and use of https://crosswaverhodes.com/ (the “Site”), booking services, and related offerings by CrossWave Malta (“we”, “us”, “CrossWave”, address/contact as above). By using the Site or booking, you agree to these Terms, our Privacy Policy (incorporated herein), and applicable laws. If you are booking for others, you confirm authority to bind them.
1. Booking and Payments

Bookings are subject to availability; confirmation via email does not guarantee service if force majeure occurs.

Full/partial payment due at booking via approved methods. Prices exclude extras (fuel surcharges, food, etc.) unless stated.

Cancellations: Free up to 48 hours before; 50% fee 24-48 hours; 100% within 24 hours or no-show. Tour operator policies may apply stricter rules.

Refunds only for our direct fault; no refunds for weather/user issues.
2. Platform Role (Key Protection)
We act solely as an intermediary/booking agent, not principal. We do not own/operate boats, employ crew, or guarantee tour quality/safety. All tours by independent operators (“Suppliers”); book at your risk. We disclaim all warranties, express/implied, including fitness for purpose.
3. User Obligations

You must be 18+ or accompanied by guardian; provide accurate info; comply with Supplier rules (e.g., licenses, health declarations).

Prohibited: Illegal activities, harassment, false bookings. We may cancel/suspend accounts without refund.
4. Liability Limitations (Key Protection)
To maximum extent permitted by law:

No liability for Supplier acts/omissions, weather, pandemics, force majeure (strikes, etc.).

Total liability capped at booking amount paid to us.

No consequential/indirect damages (lost profits, injury unless gross negligence).

You indemnify us against claims from your party/breaches.
Governed by Maltese law; disputes in Malta courts or Malta Arbitration Centre.
5. Intellectual Property
Site content (logos, images) ours/Suppliers’; licensed for personal use only. No scraping/reproduction.
6. Force Majeure
No liability for failures due to events beyond control.
7. Termination
We may terminate access anytime for breaches without notice/refund.
8. Governing Law
Malta law; exclusive jurisdiction of Malta courts.
9. Changes
Terms may update; continued use = acceptance.
